Terms of Service

BenchMarked is provided by a sole trader operating as BenchMarked, based in the United Kingdom. In these terms, "we" and "us" mean BenchMarked.

It may be used from any jurisdiction in which such use is lawful and in which your broker is one we support.

You grant read-only access to your brokerage account. We read your transaction history and present the performance of your portfolio against a selected benchmark, applying the same amounts on the same dates.

You must be aged 18 or over and hold your own account with a broker we support. One account per person.

You are responsible for maintaining the confidentiality of your sign-in details and for all activity under your account. Notify us if you believe it has been accessed by another person.

We request read-only access only. The method of granting it depends on the broker: some issue a key that you generate and supply, others use an authorisation flow in which you approve access at the broker.

Where the broker allows you to determine the scope of the connection, grant read access only. Where we request the scope on your behalf, we request read access only.

You may withdraw the connection at your broker at any time, by revoking the key or removing our access, with immediate effect. We cannot alter your broker's permission settings, and you should review them before connecting.

On a day for which no closing price exists, such as a weekend, a public holiday, or where the feed lags, we value a holding using the most recent close within the preceding ten days. Where that is unavailable, and we also have no close in the ten days after, the holding is excluded from that day's total rather than estimated. Instruments for which no price data exists are identified on your dashboard.

Market data may be delayed, incomplete or inaccurate. Data supplied by your broker may also be incomplete. Currency conversion will not correspond exactly to your broker's. The comparison is a model and does not reproduce the spreads, fees and taxes a purchaser would have incurred. Figures may differ from your broker's own, and a difference does not of itself indicate an error in either.

BenchMarked is provided on an "as is" and "as available" basis. We give no warranty that it is accurate, complete, uninterrupted or fit for any particular purpose, save as required by law. Do not act on any figure without verifying it against your broker.

BenchMarked is a beta service. It may be unavailable, may change, and may be discontinued. We may suspend or withdraw it, or any part of it, at any time.

You must not attempt to gain unauthorised access to the service, disrupt it, scrape it at scale, resell it, or use it to contravene any law or infringe the rights of any person. We may suspend or close an account used in breach of this section.

The site, its design and its code are our property. Your data remains yours and we claim no ownership of it. Market data remains the property of the providers from whom it is licensed.

Nothing in these terms excludes or limits liability which cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence and for fraud. Nor does anything in them affect rights conferred on you by consumer law which cannot be excluded by agreement.

Subject to the above, and BenchMarked being provided free of charge, in pre-release form and for information only, we are not liable for any investment decision or its consequences, for loss arising from third-party data being inaccurate, delayed or unavailable, from the acts or omissions of your broker, or from unavailability of the service, or for indirect or consequential loss, loss of profit, or loss of data, to the extent the law permits such exclusion.

There is no paid tier. Nothing may be purchased on BenchMarked, we do not collect payment details, and there is no subscription to cancel.

Premium features exist and function, but no means of purchasing them is provided. Where such features are enabled on an account, they were enabled by us and no charge arises. Should a paid tier be introduced, terms as to payment, renewal, cancellation and refunds will be published before any purchase is possible.

You may cease using BenchMarked at any time, disconnect your broker, and request deletion of your account. We may suspend or close your account if you breach these terms, or if we discontinue the service.

We may amend these terms. The date above identifies the current version. Material changes will be notified before they take effect.

These terms are governed by the law of England and Wales, and its courts have exclusive jurisdiction. If you are a consumer resident elsewhere and your local law confers protections that cannot be excluded by agreement, those protections are unaffected.
